Terms of Service

1. The Service

LexiNote is a personal language-learning tool that allows users to upload study material (text, images, PDFs), automatically extract vocabulary and phrases, search their personal learning history, and generate quizzes based on their own saved content. The service is provided by MbMedia and delivered via the website at lexinote.app.

2. Eligibility

You must be at least 13 years old to use LexiNote. By creating an account, you confirm that you meet this age requirement and that the information you provide is accurate and complete. If you are using LexiNote on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your Account

You are responsible for maintaining the security of your account credentials. Do not share your password with anyone. Notify us immediately at hello@lexinote.app if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or appear to be fraudulent.

4. Subscriptions and Billing

LexiNote offers a free plan and a paid plan. Plan features and limits are described on our Pricing page.

• Paid subscriptions are billed on a monthly or annual basis.
• Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis.
• Subscriptions renew automatically until cancelled.
• You may cancel your subscription at any time from your account settings. Access to paid features continues until the end of your current billing period.
• We do not offer refunds for partial billing periods, except where required by applicable law.
• We reserve the right to change plan pricing with at least 30 days' notice to existing subscribers.

5. Your Content

You retain ownership of all content you upload to LexiNote, including notes, images, and PDFs (“Your Content”). By uploading content, you grant MbMedia a limited, non-exclusive licence to process, store, and display Your Content solely for the purpose of providing the service to you.

You represent that:

• You own or have the right to upload Your Content.
• Your Content does not infringe the intellectual property rights of any third party.
• Your Content does not contain material that is unlawful, harmful, abusive, or otherwise objectionable.

We do not use Your Content to train AI models or share it with third parties beyond what is described in our Privacy Policy.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable law.
• Upload content that contains malware, viruses, or other harmful code.
• Attempt to gain unauthorised access to the service, other user accounts, or our infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of LexiNote.
• Use automated tools to scrape, crawl, or excessively load the service.
• Resell, sublicence, or commercialise the service or any output derived from it without our written permission.

7. AI-Generated Content

LexiNote uses AI to extract vocabulary, structure notes, and generate quiz questions. AI-generated output may occasionally be inaccurate, incomplete, or inconsistent. You are responsible for reviewing AI output before relying on it for learning. MbMedia does not guarantee the accuracy of extracted terms, translations, or quiz content.

8. Intellectual Property

LexiNote, including its design, code, branding, and features, is owned by MbMedia and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.

9. Service Availability

We aim to keep LexiNote available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, outages, or events beyond our control. We are not liable for any losses resulting from downtime or service interruptions.

10. Disclaimer of Warranties

LexiNote is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or suitable for any particular purpose. Your use of the service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, MbMedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or in connection with your use of LexiNote, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may delete your account at any time from your account settings. MbMedia may suspend or terminate your access to the service if you violate these Terms or if we decide to discontinue the service, with reasonable notice where practicable. Upon termination, your right to use the service ceases immediately and we will delete your data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before they take effect. Continued use of LexiNote after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which MbMedia operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
